1. Who you're contracting with
These Terms are a contract between you and Shape your body ("we", "us", "our"), a female-only Pilates studio offering hot mat and classic mat classes, events, and an online members' community (together, the "Service"). By creating an account, booking a class or event, purchasing a membership, or otherwise using the Service, you agree to these Terms.
2. Eligibility
You must be of legal age to enter a contract in your country of residence, or have permission from a parent or guardian. Classes are offered to women only. You confirm that any information you provide is accurate and kept up to date.
3. Accounts
You are responsible for keeping your login credentials confidential and for all activity that happens under your account. Notify us immediately if you suspect unauthorised access.
4. Acceptable use
You must not misuse the Service. In particular, you must not:
- use the Service for any unlawful, fraudulent or abusive purpose;
- send spam or harass other members in the chat or via direct messages;
- infringe anyone's intellectual property or privacy;
- probe, scan, scrape, reverse engineer, or interfere with the security or integrity of the Service;
- attempt to circumvent booking limits, membership credit limits, or the QR check-in system.
5. Payments, memberships and Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Memberships are billed monthly in advance and renew automatically until cancelled. Class credits reset at the start of each billing cycle and do not roll over. Event tickets are one-off purchases. Full payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms and our own Refund Policy.
6. Bookings, cancellations and studio conduct
Class and event places are subject to availability. Please arrive on time; late arrivals may be refused entry for safety reasons. You are responsible for disclosing any medical conditions or injuries that may affect your ability to take part safely. If you cannot attend, please cancel your booking as early as possible so someone else can take the space.
7. Intellectual property
The Service, including its software, branding, class content and written materials, is owned by Shape your body and its licensors. We grant you a limited, non-exclusive, non-transferable licence to use the Service for personal, non-commercial use in line with your membership. You may not reverse engineer, resell, redistribute or circumvent any technical limits.
8. User content
You retain ownership of the content you post (chat messages, profile photo, bio). By posting it you grant us a worldwide, non-exclusive, royalty-free licence to host and display that content for the purpose of running the Service.
9. Suspension and termination
We may suspend or terminate your access without notice for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations (including abusive behaviour in the community or at the studio). You may cancel your membership at any time from the members area or the customer portal provided by Paddle.
10. Service level and warranties
We work hard to keep the Service running smoothly, but we do not guarantee that it will be uninterrupted or error-free. To the fullest extent permitted by law, all implied warranties of merchantability and fitness for a particular purpose are disclaimed.
11. Liability
To the fullest extent permitted by law, our aggregate liability to you for any claim arising out of the Service is limited to the fees you paid us in the twelve months before the event giving rise to the claim. We are not liable for indirect, consequential or special damages (including loss of profits, data or goodwill). Nothing in these Terms excludes liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.
12. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law
These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction over any dispute, unless a mandatory local law says otherwise.
